Personally, when I receive money from my parents, I will apply for ATO private ruling afterwards rather than in advance.
Firstly, without a real transaction, it is very hard for non-tax-professional taxpayers to get the idea clear in the ruling.
Secondly, you ruling will be null and void if ATO play dirty by claiming that the details of the real transaction is different from your description in your ruling beforehand.
Despite my new job, my experience and expertise were mainly on Taxation law rather than Tax compliance, though I am working in tax compliance now and gaining experience quickly. My article is trying to give Australian Chinese a big picture as to how ATO works and how far ATO could go and provide an low-cost alternative to taxpayers.
So I could not comment on what proof you need to substantiate that it is not your income.
Intuitively, my guts-fee is that merely adding some words to the description may not add much weight to your argument. In western law and finance, there is always a concept of "substance over form", so what one transaction essentially is could be quite different from what it is called. |
