Even though the employer groups didn’t achieve the objective of aligning Saturday and Sunday penalty rates and there is the delay to contend with, they won’t be complaining about the decision. After all, Bill Shorten had said during the election campaign last year that he was absolutely sure the Fair Work Commission wouldn’t touch penalty rates.
And given the Opposition Leader’s involvement with the introduction of the Fair Work Act, including related amendments, under which terms this review of penalty rates was conducted, many of us wondered at the time whether he knew something that we didn’t.
Don’t forget most of the appointments to the FWC were made by the recent Labor governments, of which Shorten was part. When Shorten was employment minister, he even went to the trouble of amending the Fair Work Act to add that modern awards should include: “The need to provide additional remuneration for: employees working overtime; or employees working unsocial, irregular or unpredictable hours; or employees working on weekends or public holidays; or employees working shifts.” This is covered in section 134 (da).
