LEC本来就是个便民工程，让老百姓不用花费很多，就能解决纠纷。不是很复杂，至少没corporate accounting 难

2007年有过类似的案子， 法庭判树的主人没有breach duty of care. 因为树是健康的， 在大雨中倒下，属不可预测范畴。

我想了一下， 如果再去和council谈，是不是可以用书面的形式表达一下的意思：

I would like to keep this tree so that both my neighbor and I can enjoy the view, landscape and shade bought up by the tree, though the present of the tree, the two branch overhanging my house, posts a real risk to my property in the event of a storm, judging from the branches' height, angle and span. In particular this tree did drop small branches from time to time when there is a strong wind.

The branches are so low and so close to my house, the way it sways and shakes during strong wind makes all my family start to worry. The anxiety it caused within my family is stressful and unpleasant.

I am offering, at my cost, to trim the branches back to a least extent such that the branches may miss my house in case it falls. I am also offer, at my cost, to trim some branches on the side of my neighbor to keep the tree in balance and minimize any potential risk they may pose on my kind neighbor so that the effect of trimming would be minimal and the tree can continuously thrive in its usual way and could be enjoyed by all of us.


如果刮大风时，有树叶刷到屋顶产生噪音，一定要写上，以前有这样一个案例，最后树给砍了。

这个帖子真是太好了。借此机会询问行家。邻居家的gum tree 的树枝倒下来把我家屋顶砸了。我们自己出钱修好了。我想问一下能不能问他share维修费用呢。我去找了邻居，他还不知道，因为在白天他可能上班去了。说明情况，他很爽快就立马填表申请砍树了。但是他也没主动提share费用，我也不好意思提。那个树目测也不好说是不是缺乏维护，也没有以前掉树枝的数据。这种情况是不是他有权不share费用，我自认倒霉的。谢谢！

这种情况应该是你向自己的保险公司claim的
