你就和那个builder或者Council 说,我没有收到Form 3 Protection Work Notice, 没有在Form 4上签字,他们怎么拿到的Building Permit?按照规定,Building Permit应该在工地上有一份,如果没有就是他们没按规矩做,那么就问Builder要一份,你告诉他们你要和building suveyor联系,问为什么有build over boundary, 却没有Form 3&4 Protection Work Notice, 但是却issue the building permit?
建议不要联系council先,先和builder沟通,你如果不同意拆fence, 砖墙真得会很难看。因为他不拆的话,也可以从他那一侧砌墙,但是砖缝没法处理,以后也不会用酸洗砖,那肯定不好看。
Council也不会介入太多,最好你们自己沟通,你只要提到Protection Work Notice, Builder 应该就怂了,你可以把Building Surveyor和Builder一起告了。
你的担心无非就是怕他占你地,还有fence不结实。我的建议是,你直接提出你的条件,因为无论你做什么,他们都会继续工程的,你拖他们时间,并不会有什么好处。以下几点建议:
第一步,
1, request a copy of building permit
2, a copy of endorsed town planning permit and Town Planing Drawing
3, a copy of engineering drawing showing the concrete footing along the boundary
4, a copy of working drawing showing all the window schedule
第二步,拿到这些图,然后看一下,没有什么特别的话,提出以下条件,
1, make sure the footing on the boundary is not over the boundary, no concrete should be in my property
2, Brickwork should be acid washed and have a nice and clean finish
3, Erected the temporary fence immediately after fencer down, and Fix the Fence as long as the brickworks done
4, Reinstate the landscaping and whatever damaged during the construction
5, I will sign the protection work notice and agree the brick layer to use my land to laying the brick along the boundary, once above four requirements are agreed by builder by writing.
作为Builder,也挺不容易的,希望楼主与人方便,与己方便,如果你对图纸不是太通,直接提出第二步也可以。
