有一个关于RRV的老贴今日有人顶起，看到回帖中一些东西已经是没有时效的，所以觉得有必要根据现行法律以及移民局的政策来写一下这个问题
提醒大家，法律是一直变的，以前的就都不作数了，今天的下面所写的就现在有效哦。
你别三五年后来说，你2013年时发帖时啥啥啥...本人免责的哦，仅代表这个ID所说的，不代表真实世界中的我提供咨询哦。
各位千万不要吝啬溢美之词，加分别手软啊。

【1】Analysis of relevant cases indicate that the courts have accepted that a person who previously lived in Australia as a permanent resident, however defined, is a former Australian permanent resident.
【2】 If a permanent resident is granted a temporary visa which comes into effect (that is, not an ETA or Border visa) the person becomes a temporary resident on the date of grant. However, if an applicant is a former permanent resident, the grant of a temporary visa or refusal of an RRV does not change this status. That is, they continue to be a former permanent resident and may, in the future be eligible for an RRV.
【3【If there is evidence that a person was a permanent resident in the past, but has since departed without a valid returning resident re-entry facility, or has subsequently been granted a temporary visa, they can obtain an RRV to allow them to regain their permanent resident status.
【4】以往，移民局说，RRV的申请人是要求最近一个签证是PR，才能算是“前永久居民”（former permanent resident），另外两种人也可以申请RRV：前公民但是没有公民身份了或者放弃了公民身份的，当前永久居民。 但是现在，法官的判例造成，曾经是有PR签证的，PR没有被移民局“取消”的，因为种种原因PR签证无效了/过期了，可以符合former permanent resident的定义。 快点给法官大人们撒花啊！
【5】这个规定意味着什么呢，如果你的5年PR到期了，人在境外，怎么办进不来了，如果境外不给RRV遇到拒签，申请短期签证，（ETA和Border visa除外），进澳洲然后再申请RRV也可以！！ 进来以后是持有短期签证，还是可以申请RRV，申请的身份就是 former permanent resident!!!!
申请就算遭拒，还可以再申请，再申请，再申请，直到移民法再次改变，不让这批人申请...将来是有可能的哦，移民局一向是心狠手辣的。
但是要注意，申请RRV仍旧要满足RRV的条件，5年 1年 3个月三种。如果你申请RRV仍旧遭拒，那么你一定要注意当前持有的短期签证的有效期和签证限制条件哦，绝对不要黑民。一旦黑民，要想申请很多签证都不能申请啦。 |
