LED 灯进口 与 2017年海关编码大幅调整

自2017年1月1号起,WCO 编制的新版海关分类代码开始使用,澳大利亚海关与边境保护局(简称“澳大利亚海关”)也同时开始使用新版的分类系统。

这一次系统的更新变化很大,很多常用的产品的海关分类发生变化,影响到进出口商的文件制作。

以LED灯泡为例,之前的海关分类为8543,现在改在8539.


更多的产品编码信息变化,可以咨询自己的报关公司或咨询澳大利亚海关相关部门。

墨尔本机场查获5公斤可卡因,一名男了被捕

    Man charged with importing 5 kilograms of cocaine through Melbourne Airport                  24-02-2017 -           
A 34-year-old Australian man is expected to appear before Melbourne Magistrates Court today, charged with importing about 5kg of cocaine through Melbourne International airport.
After arriving on a flight from Italy last night (23 February 2017), Australian Border Force (ABF) officers selected the man for a baggage examination.
ABF officers will allege they identified a piece of plywood inconsistent with the construction of the man’s suitcase. The suitcase was then x-rayed with anomalies detected.
ABF officers then deconstructed the suitcase, revealing a white substance behind the plywood partition.
Initial testing of the substance returned a positive result for cocaine. Further forensic testing will be conducted to determine the exact weight and purity of the substance.
Australian Federal Police (AFP) officers attended and arrested the man, later charging him with:
• Importing a commercial quantity of a border controlled drug, contrary to section 307.1(1) of the Criminal Code 1995 (Cth).
• Possessing a commercial quantity of a border controlled drug, contrary to section 307.5(1) of the Criminal Code 1995 (Cth).
The estimated street value of the cocaine is $1.63 million. These charges carry a maximum penalty of life imprisonment.
ABF Regional Commander Victoria, James Watson said that this seizure is another example of the good work carried out by our officers every day at the airports across the country.
“This seizure demonstrates the capacity of ABF officers on the frontline to identify and disrupt the importation of drugs into Australia,” Commander Watson said.

澳大利亚海关与边境保护局(以下简称“海关”)最近收到了全国审计委员会关于海关行使法定权力的审核报告。
海关同意审计的三个基本建议,但是对于某些具体的活动还需要进一步的澄清。
海关是一个执法部门,涉及到各种活动,包括协助货物与人员进过边境,保护机场、港口,防止移民欺诈,有组织的跨国犯罪对国家的威胁。
对于调查报告中提到的超越权限执法的问题,海关会进行调查。


    Response to ANAO report on the Australian Border Force’s use of statutory powers                  27-02-2017 -           
The Department welcomes the finalisation of the Australian National Audit Office’s (ANAO) report on The Australian Border Force’s Use of Statutory Powers and agrees primarily with the three recommendations. There are, however, certain matters presented in the report which require clarification.
The Australian Border Force (ABF) is the operational enforcement arm of the Department, responsible for a diverse range of activities, including facilitating the lawful passage of people and goods across the border. ABF officers protect Australia's airports, seaports, international mail and cargo streams from the entry of illegal and harmful goods, those intending to commit immigration fraud, organised and transnational crime and national security threats.
The ABF also conducts investigations, compliance and enforcement operations in relation to the Migration Act, Citizenship Act, Maritime Powers Act and Customs Act and other offences related to illegal activity at the border.
The current range of ABF statutory powers represent the consolidation of the powers which existed in the former Department and former Australian Customs and Border Protection Service prior to integration on 1 July 2015. The Australian Border Force Act 2015 did not create new powers to be exercised by ABF officers.
The Department has informed the ANAO that it does not agree with its characterisation that the powers available to ABF officers are solely coercive powers. While some powers are clearly coercive, such as the power in s.18 of the Migration Act 1958 to require a person to give information or produce a document about an unlawful non-citizen, many other powers are administrative, such as the power in s.25(1) that allows ABF officers to inspect and make copies of a document produced under s.18.
Further, the Department notes the report’s conclusions that the ANAO found instances of potentially unlawful searches of and failure to comply with mandatory instructions under both the Customs Act 1901 and Migration Act 1958. The Department contends these instances are in the category inadvertent and administrative breaches rather than deliberate and intentional breaches. Notwithstanding, the Department is conducting a detailed review to verify whether the searches were conducted lawfully/appropriately, identify and address any control weaknesses, and if recommended by the review, will take necessary remedial actions.
Recommendations
The Department has taken account of the issues raised in the report and has provided responses against all recommendations. A summary of the Department’s response is outlined below.
Recommendation one
The Department agrees with this recommendation and will ensure that the risk of officers exercising powers unlawfully or inappropriately due to inadequate guidelines, training or supervision is addressed as part of its review of enterprise risks to be undertaken in the first half of 2017.
Recommendation two
The Department agrees in principle with this recommendation. Significant progress has been made by the Department to upload all operational instructions, guidance, delegations and authorisations to the Document Control Register. Currently, there are 645 documents that are accessible to staff on the Policy and Procedure Control Register (PPCR) which is a single point of access to policies and procedures, and direct access to delegations and authorisations.
While the Department agrees that an integrated platform for instructions, guidance, delegations and authorisations should be delivered, its ability to do so within one year will be conditional upon the availability of sufficient funding and resourcing.
Considerable progress has already been made with the implementation of the PPCR and successful commissioning of a technical upgrade of the LEGEND system to accommodate delegations, authorisations and Customs legislation.
Recommendation three
The Department agrees with this recommendation. The Learning and Development Branch is continually working with the ABF College and relevant business lines to ensure the certification of training records relating to statutory powers are entered into the Learning Management System (LMS).
The Department is conducting training needs analysis in roles that require officers to exercise coercive powers which will then assist in identifying the pre-requisite qualifications in ABF roles. The enhancements to the LMS that are underway will align an individual’s position to a job role and then to the curriculum and relevant qualifications.

New Departmental headquarters in ACT

Recent media reporting on the Department’s submission to the Parliamentary Standing Committee on Public Works (PWC) for a long-term office accommodation solution for the ACT has been inaccurate and misleading.

The media reporting fails to recognise that the proposal will achieve potential lease savings for the Department of about $236 million over a 30-year period. The Minister for Finance endorsed this cost-benefit analysis last year.

The total budget for the project is $255.3 million; of which only $181.6 million is related directly to fit-out costs for one building at the airport and three in Belconnen.

The difference ($73.7 million) relates to other project costs such as staff relocations, ICT, loose furniture, white goods and contingency.

The Department is condensing its accommodation in the ACT from 12 to five buildings. This will reduce the accommodation footprint by about 13,100 square metres to 87,200 square metres in total.

Contrary to media reporting, and based on the Department’s assessment using the PWC Manual, the average fit-out costs across the four buildings will be $2053 per square metre.

It is important to note the fitout requirements have more complex specifications than are typically required for a traditional government office fit-out.

The proposal will achieve specific security, specialist equipment and facility requirements to support the Department, and its operational enforcement arm the Australian Border Force, in conducting its significant operational, law enforcement and intelligence activities.

Reporting on the lease incentive has also been misleading.

Of the $212 million incentive, $136 million is funded by the building owner with $75 million to be amortised over the life of the leases.

2月25日一艘货船触礁,160个集装箱落水 -- 记得给货物做保险

2月25日,一艘ISLA BARTOLOME货船触礁并陷入导致大量海水灌入部分淹没,船上载有160个集装箱。事故发生于刚离开Guayaquil(瓜亚基尔港,厄瓜多尔)不久。



  地方当局、 海岸警卫队和海军迅速展开救援,所幸船上无危险品,装有一般商品与冷冻食品。当局已发起对这次事故的根本原因的调查。现不确定技术故障或人为错误。




  此船88.60米长,船体型宽15.20米然后最大吃水6米,建造于孟加拉国的吉大港,载重3818DWT。

请问一下,我在国内有一些普洱茶,大约三四十公斤的样子(因为普洱茶可以久存,每年买一些就存的多了),一直是每次回国时带一些够喝的申报进关,现在想一次性都运到澳洲,应该怎么操作呢?总价值肯定超过1000澳币,交税是肯定的,问题就是这些茶叶有些是正规厂家生产的,上面有厂家名称什么的(但是肯定没有英文),有些是茶商自己包装的,也都不是密封包装的。好像一般空运都不运食品。

进口清关过程中的文件正确性与清晰程度。

澳大利亚海关的清关以文件清关为主,实际验货清关的情况非常的少。在很多时候,海关甚至只需要报关公司提供的电子数据即可放行。长期工作产生的惯性使得客户产生的懈怠心理:被抽中的可能性非常小,混一下就过去了。

就在这貌似宽松的情况下,一旦海关发现某个蛛丝马迹,就可能一直上溯到前面4-5年的所有案例,逐条的核实工作,可能会导致清关公司无法正常运转。

为了避免各种麻烦,只能从最开始时严格要求自己,从而杜绝所有的隐患

一张熏蒸证书引发的“血案”

熏蒸处理是亚太国家在国际贸易中对于木质材料通行的处理方式,各国都使用的非常成熟,现在已经很少出现问题。我每年经手处理的熏蒸证书有数百票,已经4-5年没有看到这个证书被拒的情况,却没有想到最近经手的一票货中碰到了一次。

事情过程很简单,
1.     在货物到港前3天拿到清关文件,按程序申报之后,商检局反馈的结果是在熏蒸证书上发现不符点,要求查验正本
2.     正本文件在2天后到达商检局,经过核对,被认定为伪造的假证书
3.     与收货人确认之后,将货柜转到熏蒸场所处理
4.     处理结束后再送货
额外损失:
1.     额外的拖车费用
2.     熏蒸处理费用
3.     码头超期存储费用
4.     船公司超期使用货柜费用
七七八八加起来,大约多出1500-1700AUD的费用,而这个事情的起因就是中国货代出具了一份不符合澳洲商检局的证书。而这个证书在中国的成本不会超过180AUD

结论是什么,已经不必要说了。

一名捷克国籍男子因为走私昆虫补罚款2000AUD,并被逮捕

220日一名从PERTH登机前往沙特首都阿布扎比Abu Dhabi的男子被海关选中进行行李检查。
在检查中海关发现4226个昆虫,27个蝙蝠,7个蝎子。海关把这些动物到西澳博物馆进行检查
这些昆虫被放在种塑料盒,密封袋子与塑料瓶了里。

很多昆虫属于澳大利亚珍惜物种。。。。

据介绍,很多澳大利亚本地昆虫品种在海外的需求量很大,经营这种生意可以获得很高的利润。
澳大利亚海关的有一项重要项职责是保护本地的野生动物,防止他们成为走私者的猎物。

Joint operation stops $101 million of crystal methamphetamine from hitting Australian streets
27-03-2017 -

This is a joint media release between the Australian Federal Police, New South Wales Police, the Australian Border Force, the Australian Criminal Intelligence Commission and the New South Wales Crime Commission

Five men have been arrested and charged following a sophisticated joint agency operation in Sydney and Guangdong Province, People’s Republic of China, that resulted in the seizure of more than 100 kilograms of crystal methamphetamine, commonly known as ‘ice’ in China. If the drugs had reached Australia, they would have an estimated street value of AUD$101 million.

Operation Valencia was an investigation conducted by the NSW Joint Organised Crime Group (JOCG) – comprising members from the Australian Federal Police (AFP), New South Wales Police, Australian Border Force (ABF), Australian Criminal Intelligence Commission (ACIC) and the New South Wales Crime Commission (NSWCC) – which included significant cooperation from Taskforce Blaze in China, coordinated by the AFP’s Guangzhou Post.

The operation began with information from Taskforce Blaze that 101 kilograms of crystal methamphetamine was concealed in the floor of a shipping container departing Yantian Port, Shenzhen, China, for Sydney.

A 22-year-old Fijian national was arrested on Friday, 24 February 2017, for his alleged role in facilitating the attempted importation after the container was delivered to an address in Western Sydney.

Two other men, a 38-year-old Australian man and a 42-year-old Hong Kong resident, were arrested and charged later on the same day for their alleged involvement in this syndicate.

All three men were charged with:

• Attempting to import a commercial quantity of a border controlled drug, contrary to Section 307.1 of the Criminal Code Act (Cth) 1995; and

• Attempting to possess a commercial quantity of a border controlled drug, contrary to Section 307.5 of the Criminal Code Act (Cth) 1995

Subsequent activity in Guangdong Province, China, resulted in the arrest of one Chinese national and one Hong Kong resident in relation to the supply and shipping of the drugs.

Australian Federal Police Detective Acting Superintendent Luke Needham, Coordinator Organised Crime, said this operation highlights the benefits of continuous collaboration between partner agencies.

“This operation is yet another success for our Taskforce Blaze partnership with the Chinese National Narcotics Control Commission,” Detective Acting Superintendent Needham said.

“This unprecedented merging of our two countries’ efforts to combat organised crime is continuing to pay dividends in the form of harmful drugs that will never reach Australian streets.”

NSWPF Organised Crime Squad Commander, Detective Superintendent Scott Cook, said strong law enforcement partnerships are imperative to disrupting transnational organised criminal groups.

“By working in conjunction with our interstate, national, and international partners, the Organised Crime Squad can extend its reach to target criminal networks impacting on NSW no matter where they’re operating from.”

ABF Regional Commander NSW Tim Fitzgerald said the operation demonstrates the significant ability of Australian law enforcement to detect illicit drugs before they reach the community.

“Through intelligence sharing and world-class border screening our highly trained officers work tirelessly to stop these drugs at the border,” Commander Fitzgerald said.

“Crystal methamphetamine is a scourge which destroys lives and tears apart families. Working collaboratively with our partner agencies, we have successfully stopped a significant quantity of crystal methamphetamine reaching our streets.”

ACIC New South Wales State Manager Warren Gray said the ACIC has assessed that crystal methamphetamine poses, by far, the greatest threat to the Australian public of all illicit drug types, and by a significant margin.

“With serious and organised crime driving supply trends, and resilient user demand, the ACIC is committed to working with our partners to better understand and respond the threat that crystal methamphetamine poses to our community,” Mr Gray said.

Deputy Commander Taskforce Blaze Jianwei Deng said this operation is another success for Taskforce Blaze which is promoted by senior officials of both the National Narcotics Control Commission and the Australian Federal Police.

“This success shows that despite the current global spread of drugs, transnational drug trafficking crimes can only be curbed through strengthened international drug law enforcement cooperation.”

The 38-year-old Australian, 42-year-old Hong Kong national and 22 year-old Fijian national are scheduled to appear in Sydney Central Local Court on 26 April 2017.

The maximum penalty for the charges is life imprisonment.

澳大利亚禁止使用各种性质的石棉。
该法律在2003年12月31号生效。工作安全法禁止在澳洲全境内禁止供应、运输、使用、处理石棉,除非得到任何特别批准 。

在进口货物中,如果发现石棉,将会被直接没收并销毁,不允许再次出口。
如果在触犯该项法律,个人进口商可能会被处以18万AUD或3倍进口货物金额(取大者)的罚款;对于企业进口来说,则可以处于90万AUD或15倍进口货物金额(取大者)的罚款。
