To be an eligible sponsor, your sponsor must be able to show that s/he is settled and, that s/he is usually
resident in Australia.
Settled means that your potential sponsor has been living in Australia in her/his capacity as an Australian citizen, Australian permanent resident or eligible New Zealand citizen for at least 2 years before lodging a parent visa application. Under policy, two years is generally considered to be a reasonable period.
There may be exceptions, however, and the facts of each case are considered on an individual basis by the officer
of the department who is making the decision, particularly if there have been periods of lawful temporary residence
that can appropriately be counted towards the settled requirement. A shorter period of lawful residence may be
considered for Australian citizens for settled purposes if there are compassionate and compelling circumstances.
As a matter of policy, the eligibility period for Australian citizen sponsors in such circumstances is at
least three months’ residence.
Our Department cannot determine the sponsor eligibility before the parent visa application has been lodged. |
