[个人所得税] 作为Trust的受益人,Centrelink评估资产时会把Trust资产评估进去? [复制链接]

今天找会计师咨询Trust的事情,讨论到关于把父母作为受益人Beneficiary写入Trust时,CPA告诉我
Centrelink评估时,会因为你是Beneficiary,把Trust的资产算到你到头上,这样如果你想领取福利的话就没门了,据说他有一个客人就发生过

感觉很夸张阿,Trust最大好处就是Beneficiary只能得到Trustee分得的分红,Trustee可以写把所有有关系的人都写成Beneficiary,但不分给你不想给的人
那Centrelink怎么可以把Trust资产算Beneficiary头上呢?感觉很夸张阿,有谁能解释一下吗?

(据我所知,Family court是可以无视Trust,直接把手伸进来分钱的。。。。)

there is really no need to name your parents to be the primary beneficiary, by naming their as the primary beneficiary, it will affact centrelink benefits. even if you don't name them in the deed, you can still legally distribute profit to them via discretionary trusts (this is allowed by most deeds).
there are cases where distribute profit to a potential beneficiary end up affecting her centrelink benefit. its up to you and your accountant to workover what's more appropriate, tax/centrelink benefits.

在centrelink的private trust form上要求列出trust的asset,但是在pension asset test里面并没有要求列出trust的资产,but centrelink also said certain assets are deemed to earn income per centrelink's rate, but some assets are exclued in the asset test. so i think you should ask centrelink about trsut's asset. from my point of view, i think it wont affect the pension a lot if you do not distribute any income to the person you concerned.

The principle is that:

If you are involved in a private trust or company, Centrelink may include the income and assets of that trust or company when working out your social security payments.

The assets and income of private trusts and private companies may be "attributed" to a person based on:

a control test, and
a source test where a person transfers assets or services to a trust or company after 7.30pm on 9 May 2000.

If you are not a controller of a private trust or private company any actual distributions or dividends (including imputation credits) you receive will be assessed as income for 12 months after the date of distribution.
