[日常管理] 寻求出租租赁问题帮助 (奖励有用的建议) [复制链接]

亲爱的朋友们,

我有一个问题,谁人有类似的情况,请提供一些建议给我

1。本人通过租赁代理的4间卧室的房子给来自中国的4名学生,使用标准REIV在墨尔本合同。

2。在一个随机访问,我看到了房子is in 极其恶劣的条件。

   Firstly, 租户再没有我的许可,出租房子给其他人,有6至7人在家里的客厅生活。
     真正的承租人回到中国,将在2月返回
   Secondly, Flywindows和门被损坏
   Thirdly, 地毯非常脏了(怀疑whether it can be cleaned)
   Fouthly, 在墙上到处都是划痕。
   
   Fifthly, 厨房是(可清洗)在一片混乱
   Sixthly, 前院和后院是一个烂摊子,一个垃圾箱的盖子遗失
   
   I have taken some 照片

3。 我想问
   如何处理这种情况呢?
      如果这些bonds cannot cover 返回家到原来状态的损失?
      can I ask for extra money 要求的额外资金,以恢复保护的房子?
      由于合同未完成,何保护法?
   
   我已报告给代理事件但想要得到同样的情况人some suggestions or experience.

你通过中介给人家的 只能说中介很不负责

一般中介3个月会去一次

你提供 出租之前房间照片 然后扣除押金

结束合同 并且换个中介

I actually used the google translator to translate the English into Chinese but some words are not translate correctly, so have to use English.

The reason to have this random visit is because I was to fix something in the room reported by the tenants. It is noticed by the email through the agent.

What if the actually tenant is in china and is not back after February ?
Also what if the 押金 cannot cover the cost in returning the house to the original condition?
(By the way, I am a chinese and just donot have chinese input software in my computer)

as you are in VIC, the following answers are based on VIC condition.



What if the actually tenant is in china and is not back after February ?
It does not matter.  You could still give them notice of breach by registered mail or hand delivery, then you have some sort of evidence that the notice has been delievered.  

Also what if the 押金 cannot cover the cost in returning the house to the original condition?
Do you have a landlord insurance? You can claim the extra cost from it. if no, you may apply for some fund  from Victorian Propery Fund.

I strongly recommend you to get a landlord insurance if you are a property investor.

and you question was -

    由于合同未完成,何保护法?


as long as your REIV tenancy agreement is signed by both parties (you and the tenant), Residential tenancy ACT comes in to effect.  Then both party will get the protection through the ACT, no just the tenants or you.

suggest you talk to your current agent first.  and keep conversation in writing as much as you can.

and get quote for the extra  cost in writing too.

1.  Is the tenant fully liable to pay for the loss?

2. Can I enforce the tenant pay for the loss in restoring the house?

3. Are there any methods, that if the tenant was not paying this money, I can give them a bad police record that affects their immigration ?

I feel it is really the choose of tenant issue rather than the agent issue this time. So think it will be hard to apply that Victorian Property Fund. In addition, it takes too long to apply for that little money as the house needs to be restored as soon as possible to be released later.

you may ask the agent go to VCAT to achieve these for you. depends on the VCAT order.

3: no you cannot.

you may request the agent to put their name in a NAtional tenant database ( I called it Blacklist) , it may affect them when they try rent properties in the future.  the records will last 7 years as i remember..


I can understand your feeling , but I think their dirty living style does not derseve this much of punishment like you said before ....

Just want to find some enforcement.  I know that NAtional tenant database but doubt its effectiveness as the students may use share accommodations or not through the agent thus not useful in the end. Also some private owners do not care about this database in private lease.

天天去骂他们,越难听越管用
等他们动手揍了你,就去报警
保管有效

不过皮肉之苦就难免了
