既然你说了Road Rules 2014,为什么只盯着一句话
NSW Road Rules 2014 Part 2, Division 1, rule 12,article (3)
The shoulder of the road includes any part of the road that is not designed to be used by motor vehicles in travelling along the road, and includes—
(a) for a kerbed road—any part of the kerb, and
(b) for a sealed road—any unsealed part of the road, and any sealed part of the road outside an edge line on the road,
but does not include a bicycle path, footpath or shared path.
Note—
Bicycle path is defined in rule 239, edge line and footpath are defined in the Dictionary, and shared path is defined in rule 242.
但是在也提到了shoulder在什么情况下可以进,你说c的情况(c) entering a part of the road of one kind from a part of the road of another kind (for example, moving to or from a service road, a shoulder of the road or an emergency stopping lane),指的是要在shoulder上停车才可以,那按你的理解d这一项(d) stopping at the side of the road (including any shoulder of the road).是不是就是一句废话?C里边没有一个词提到是stop,而是move to or from,就很明确告诉你可以不可以,停车显然是你想象的,而你想象的内容其实是D里边所写的情况。

Driving on or across a continuous white edge line
150 Driving on or across a continuous white edge line
(1B) A driver may drive on or over a continuous white edge line on a road for up to 100 metres if the driver is--
(a) turning at an intersection, or
(b) entering or leaving the road, or
(c) entering a part of the road of one kind from a part of the road of another kind (for example, moving to or from a service road, a shoulder of the road or an emergency stopping lane), or
(d) stopping at the side of the road (including any shoulder of the road).
Note :
"Intersection" and
"service road" are defined in the Dictionary,
"emergency stopping lane" is defined in rule 95, and
"shoulder" is defined in rule 12.
所以这就是为什么Acts制定者是看着整个Road Rules 2014来制定的规则,不是像你这样只看一句话来制定判定offence。 |
