A payment of the break lease fee legally terminates the tenancy in conjunction with clause 51 under the Lease Agreement and the NSW RTA i.e. once the break lease fee has been paid and the possession of the property has been surrendered by the tenant the fixed term lease has ended, the tenant is not required to pay any ongoing rent (or additional fees) listed in the now “terminated” lease agreement. The same would be true if the matter was referred to NCAT.
