A payment of the break lease fee legally terminates the tenancy in conjunction with clause 51 under the Lease Agreement and the NSW RTA i.e. once the break lease fee has been paid and the possession of the property has been surrendered by the tenant the fixed term lease has ended, the tenant is not required to pay any ongoing rent (or additional fees) listed in the now “terminated” lease agreement.  The same would be true if the matter was referred to NCAT.

是的 他们的条款本身说得我觉得没问题 中介想当然了

但是买的时候中介并没有说这么多，只说如果租客毁约，空租期可以获赔到最多18周

出租期间中介联系我说房子出了问题 房客已经找了vcat来看 出了证明 说 修起来房子无法住人 所以房客要求停止合约 我说可以 我想反正有保险不怕嘛

等我修完房子 联系了保险 保险去找property manager 那个manager无法提供出房子无法住人的证据 当初的vcat report也没有写他所谓的是因为修缮时的环境不能住人 property manager出信帮我证明但是保险公司也不认

我找了vcat告了这个中介 vcat表示同情我的遭遇并且说了此中介在终止租约时其他的不正规操作 但是他们没有权利做什么 让我走small court

所以 我的意思是。。。厚脸皮的中介 根本不怕vcat 因为没啥用

谢谢分享，对的，我也觉得要脱责也会有一大堆理由，真正上court花时间不说结果也未必让人满意。
