LEVELS- SECTION 96 MODIFICATION
Council has received a Section 96 Modification for development application BD.2013.031 for a mixed use development
which proposes a number of modifications including;
• Replan apartments and floor plan layouts for Buildings A and B.
• Reduce apartment s izes and increase residential apartment numbers in Building B from 173 to 192 and serviced
apartments in building A f:•cm 90 to :09.
• Extend basement 4 to accommodate :;.n additional 42 spaces.
• Changes to the far;ade o f b:~ildi n gs A and B.
Council is not in any way committed to the application but must consider it on its merit.
Before Council decides on the proposal, you are invited to examine the plans/documentation. The plans/documentation will
be available for inspection at Counci l's Customer Service Centre, Suite I, Level 2, I•-1 7 Elsie Street, Burwood, between
8.30am and 4.45pm on Mondays to fridays. If you wish to make a submission in respect of this application, please do so, in
writing, by 2 Octobet• 201 5. Any submission received will be carefully assessed pursuant to Section 79C of the
Environmental Planning & Assessment Act I fJ79, as part of the statutory development assessment process and appropriate
conditions of consent will be imposed should Council decide to approve the appl ication. Following determination of the
application, Council will formally write to anyone who made a submiss ion advising of Council's decis ion.
Pt•ivacy Notification - In mal•ing a submissh n you may be providing Council with personal information (s uch as your
name, add ress and contact details) within the mea ning of the Privacy and Personal Informa tion Pt•otection Act 1998
(PPIPA). You have the right to make an anonymous submission. However, please be aware that this may limit the
opportunity for Council to consider and discuss the issues you have raised. In certain circumstances you will also have the
right to request tha t Council not i11clude :tour personal information in any material made available for p ublic
inspection. Council will consider any such re•')Uests in accordance with PIPPA. Each submission (including any personal
information it contains will be received by Council for the purpose of evaluating the Development Application. Copies of the
submissions (including any submission you hwe lodged) wi ll then be published, together with a report on the application by
Council staff, in the Committee's business papers. Please note that these business papers form part of the public record and
will be published on Council's website and be !~1ade available for public inspection.
