[GST] 请教这样的GST如何处理最后跟贴：Agree with michael.jyu 1. When the company constructed the properties with the intention to sell, the company is entitled to input tax credits on the costs of construction and P & E. 2. However, when the comapny leased thepreperties, the company has used the propertoes for a purpose that is not creditable. The company needs to repay the amount it has claimed by making an adjustment in the BAS 3. If the properties are rented out for at least 5 years after construction, any sale will be an input taxed supply and GST will not apply to the sale. However, any sale before the expiration of 5 years will result in the sale being a taxable supply and GST will apply. If the sale takes place within the first 5 years, it may also re-establish the entitlement to some input tax credits on the acquisitions used in constructing the properties (input tax credits on the costs of construction and P & E) and a further adjustment will be required. There will be a transitional period for taxpayers who claimed the NMETO for the 2012/2013 income year. They will continue to be eligible for the NMETO in the 2013/2014 income year provided they satisfy the existing rules. Similarly, those who claim the NMETO in 2013/2014 will continue to be eligible for the offset in 2014/2015. [公司所得税] 对于公司的海外付款/开销，ATO有什么限定吗？最后跟贴：The fact you paid to the ovrseas supplier does not deny you the duduction. They are correct. However they haven't discussed the deduction for the nature of this expense - Website Development. As the expenditure incurred on constructing the website and the consultant's fee are capital in nature, you are not entitled to a deduction for the cost of constructing the website under section 8-1 of the ITAA 1997. A deduction for the decline in value of a depreciating asset may be allowable under Division 40 of the ITAA 1997. However, the purchase of the packaged deal from the web designer has led to you holding an item of intellectual property, that is, copyright to the website design. It is not a in-house software as per Subsection 995-1(1) of the ITAA 1997. Hence even though you own the copyright over the website design as a depreciating asset for the purposes of subsection 40-25(1) of the ITAA 1997, the cost of that intellectual property is nil under Subdivision 40-C of the ITAA 1997. Therefoee you are not entitled to a deduciton under Division 40 of the ITAA 97 either. You are only entitled to a deduction under section 40-880 of the ITAA 1997(Black Hole expenditure) , calculated over a period of five years, for all expenses relating to the construction and establishment of the website. [其他信息] cgt的问题最后跟贴：It is a very complex area. I've reviwed some current legislations and the tax office rulings and come to the following conclusion, not sure if it's 100% correct. 1. When you enter into a contract for disposal , CGT event A1 will happen. The proceeds from this event will include the cash received and the market value of the shares transferred to the you. In accordance with paragraph 13 of TR 2007/D10, the proceeds will also include the market value of the earnout right, as worked out at the time of the original A1 CGT event. 2. When you receive the ear-out payment, the ownership of an earnout right will come to an end, a CGT event C2 (about cancellation, surrender and similar endings) under section 104-25 will happen. 3. The earn-out right would need to be held for at least 12 months at the time of the payment for the capital gain to qualify for the discount. Hence if your right is just covered for 6 months, you are not qualified for the 50% CGT discount even if it's paid to you after 1 year. 4. There is still no sign of legislation to change the CGT treatment of earn-outs to adopt a “look-through” approach to earnout arrangements However the Tax Office has released details of its administrative treatment for earnouts pending the introduction of the legislation. This will allow you to choose to apply the proposed look-though treatment for earnout arrangements if you entered into between 12 May 2010 and the date of Royal Assent of amending legislation.
