KFC OFFER TERMS AND CONDITIONS
This offer (“Offer”) is made by Kentucky Fried Chicken Pty Ltd (ABN 79 000 587 780) and KFC Adco Limited (ABN 22 083 047 992) of 20 Rodborough Road, Frenchs Forest NSW 2086 (“Promoter”).
Offer available only to “Eligible Claimants”. An "Eligible Claimant" is an individual who: (i) is a resident of Australia; (ii) has a current Facebook account; (iii) is not an employee of the Promoter or any of its related corporations or any of their agencies associated with the Offer; (iv) is not an employee of a KFC franchisee; and (v) is not a spouse, defacto spouse, parent, child or sibling (whether full, half, step or by adoption) of such an employee.
Offer commences at 10:30am (AEST) 29th July 2013 and closes at 5:00pm (AEST) 31st July 2013 or when Free Salsa Twister (“Product”) have been awarded to Eligible Claimants, whichever occurs first (“Offer Period”). All times and dates specified in these terms and conditions are times and dates in Sydney. Limit of one Product per Eligible Claimant, not to be used in conjunction with any other offer. Maximum 3,000 Products to be awarded to Eligible Claimants. Each Product is valued at $6.95 and must be redeemed by Wednesday 31st July 2013 (“Expiry Date”).
Subject to these terms and conditions, an Eligible Claimant who, during the Offer Period:
(i) visits www.facebook.com/KFCAustralia to “Like” the KFC Australia Facebook page; and
(ii) claims a Product by registering his/her claim ("Claim") as directed (“Successful Claimant”)
will be awarded one Product.
A Successful Claimant will be provided with a unique coupon code by email sent to the Successful Claimant’s email address as provided in their Claim (“Coupon Code”).
To redeem the awarded Product, a Successful Claimant must separately, no later than the Expiry Date:
(i) surrender the Coupon Code to a KFC staff member in store at a counter register; and
(ii) in the same transaction, order one or more other items from the range of products that may be ordered at the same time (together an “Order”).
The current purchase price(s) will apply to the purchase of the other item(s) in the Order and must be paid as directed for the Order to be accepted and the Product to be provided.
By registering a Claim, a claimant is deemed to have accepted these terms and conditions.
FACEBOOK:
(i) The Offer is in no way sponsored, endorsed or administered by, or associated with, Facebook.
(ii) By participating in the Offer, each claimant releases Facebook, Inc from any and all liability to the claimant arising in any way from the conduct of the Offer.
(iii) All information provided by a claimant in relation to the Offer is provided to the Promoter and not to Facebook.
The Promoter reserves the right, in its absolute discretion, to verify the validity of all Claims (including the right to confirm and verify the identity of a claimant, by requesting proof of identity and proof of residency. Identification considered suitable is at the Promoter's absolute discretion) and to not accept any Claim from a claimant who, in the Promoter’s opinion, has tampered with the Claim process or submitted a Claim that is not in accordance with these conditions.
To the full extent permitted by law, the Promoter, its associated companies and agencies and all those entities' personnel ("Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Claimant in connection with the Offer, including: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; (iii) any liability for personal injury or death. Nothing in these conditions is intended to exclude, restrict or modify a claimant’s rights under the Competition and Consumer Act 2010.
If the Offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Offer.
If any provision of these terms and conditions is unenforceable for any reason, it will be severed and the remaining provisions will remain in full force and effect.
CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS OFFER OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS OFFER MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
Claimant personal information will be collected by or on behalf of the Promoter to enable it to administer the Offer and, if a claimant consents, may be used to market its products to the claimant. The personal information of the claimants may be provided to others assisting in the conduct of the Offer, including the supplier and deliverer of the Product. Persons may contact the Promoter by post at the address stated in condition 1 to request access to, or corrections of, any of their collected personal information that is held by the Promoter. If a claimant does not provide accurate personal information the Promoter may determine that they are not eligible to be awarded a Product.
