Employee Rosters and Time Sheet Requirements
The Hospitality Industry (General) Award 2010 provides the following arrangements for the rostering of employees:
Rostering
30.1 A roster for full-time and part-time employees showing normal starting and finishing times and the name of each employee must be prepared by the employer and must be posted in a conspicuous place accessible to the employees concerned.
30.2 The roster will be alterable by mutual consent at any time or by amendment of the roster on seven days‘ notice. Where practicable two weeks‘ notice of rostered day or days off should be given provided that the days off may be changed by mutual consent or through sickness or other cause over which the employer has no control.
Please note that the roster requirements within the award are only applicable to full time and part time employees but casual employees are shown on a roster for operational and management reasons. Casual employees should be continued to be included on rosters.
For full time and part time employees, there is an obligation to show the employees commencement and finishing times on the roster along with the employees name (not a nick name). The practice of rostering a full time or part time employee as say ’4.00 pm to close‘ is not in accordance with the award as this does not stipulate the finishing time for the employee. The rostering of casual employees from say ’4.00 pm to finish‘ does not contravene the award obligations.
Rosters should also be retained as part of your employment records as in the event of an audit or investigation by the Fair Work Ombudsman, rosters, time sheets and pay slips will be required to be produced.
All employees should complete a time sheet for each shift worked. This time sheet must show the employee‘s commencement time, finish time and actual times that breaks were taken. An employee working five or more hours in a day (including a casual employee) must be granted an unpaid meal break of at least 30 minutes and it is essential that this break be shown on the employee‘s time sheet. If the employee has a paid 20 minute break in accordance with clause 31 of the award, that 20 minute break should be noted on the time sheet.
It is recommended that all time sheets should be signed or initialed by the employee at the conclusion of each shift and also countersigned as approval by the employee‘s supervisor or manager at the conclusion of each shift. Any alterations to a time sheet must have that alteration authorised by way of the changes being initialed by both the employee and the employer.
Salaried employees earning more than $55,000 per annum, indexed from September 2006 (and excluding bonuses, loadings, allowances and the like) whose employment arrangements are not subject to overtime and other award salary variations should continue to complete an attendance time sheet for attendance at work, annual leave personal leave and public holiday recording purposes.
