请教大虾们：
啥叫信托啊(trust)？和solo trader,company 有啥区别?

我目前是solo trader,我太太全职工作，有两个孩子。

我的会计建议我下个财政年度改成信托。他说，信托最大的优势是可以自由分配收入，因为我的年度收入很难预测，所以到财政年度底，就可以根据我生意和我太太的工作收入来选择如何分配我和我太太在我们生意上的份额，来进行最大优化地避税（按照这个财政年度，两人收入差距还是蛮大的）。而且我的两个孩子也可以纳入信托，一人最多可分配2000，就有4000可不用纳税，按平均30％税率计算，就省下240，足够弥补给会计的保税费用的差额（他告诉我给信托报税比给solo 多100左右的手续费），还有信托建立时需要专业律师出一份文件（可能就时如何分配财产吧）需要几百块。其他就没有太大区别。

请大虾们讲讲信托这玩意是啥，好像很少听大家讲到。

我想问一下，LZ的身家是否很丰厚呢？如果是就可以考虑一下。

have a little confidence in your accountant, no one here knows your situation better than your accountant. trust is commonly used trading vehicle in today's business. its rarely heard in the asian community, because it is poorly understood in alot of small firms.
consult with another accountant if you have doubts, don't dismiss the idea so quickly just because a random person in this forum have a different opinion. even professionals make mistakes all the time, not to mention non-professionals.

Trusts
A trust is a popular type of business arrangement for small business but, unlike a company, is not a legal entity and cannot contract in its own right. Giving the name of a trust as the employer of apprentices/trainees is incorrect, as a trust cannot employ apprentices/trainees.

However, in circumstances where a trust arrangement is indicated, there will be a trustee conducting the trust’s business on behalf of the members of the trust. The trustee, often a proprietary company established for the purpose, contracts on behalf of the trust and accordingly would be the legal employer of the apprentices/trainees indicated as employed by the trust.

Unit Trusts
Note that where a unit trust arrangement is indicated, the terms of unit trusts divide the ownership of the trust into a number of equal units issued to investors, companies or other joint ventures. In the case of unit trusts, as with other trusts there must be a trustee appointed, as in the case of all trust arrangements, the unit trust trustee should be indicated on the TC as the legal employer of the apprentice/trainee.

Trust deed

A document conveying title to trust property to the trustee and setting out the purpose for which a trust has been formed, the rights and obligations of the trustee, of the trust's manager and of the trust's beneficiaries. The trust deed lays down the rules within which the trust must operate, dictates its investment guidelines and describes how benefits will accrue to the beneficiaries (such as unitholders) under the trust.

楼主说的估计是Family trust，会计都这么建议的。Trust 是平衡法体系下的概念，简单的说就是财产所有人为受益人带为管理财产。比如说你的房子虽然是在楼主名下，但是要是你建立一个信托，说某某是信托受益人，然后把那个房子宣布为信托财产, 则房产的收益就要归收益人了，虽然房产还是在你的名下。

貌似LZ还要做beneficiary吧
记得trustee不可以是beneficiary？

trustee cant be the only beneficiary, 不然托管人和收益人是一个了，trust就没有意义了。family trust 多是discretionary的，trustee可以是所有beneficiary中的一个。
