挡土墙应该谁负责？

邻居今天来找我们想修前园的挡土墙，想一家各出一半钱修，我家是在高的这边，两家中间原来只有几颗大树分隔（大树属于他们家，刚好种在分界线边上），然后斜坡草地到他家

我知道fence是各家一半出钱的，挡土墙呢？也是一家一半分担吗？

挡土墙，谁想修谁掏钱。当然关系特别好，无所谓那就另说了。

挡土墙如果属于fence的一部分那需要出钱，如果完完全全在他那边拿就不需要出钱

我建议你最好不要参与。因为这里还有连带的将来对挡土墙的维护维修责任。目前的retaining wall是他自己的，也就是说全部由他负责。如果变成公共的，将来有任何问题一人一半，造成任何财产损失也不必他全部负责。譬如现在挡土墙倒了，砸坏fancing，无意外是他全责。如果挡土墙成为公共部分，倒了的话双方都有责任。将来的维护维修你也要出一半。而这个挡土墙似乎对你没有帮助。

总之是对他百利无一害，对你好像就不太有利。

邻居分明是要占你便宜啊, 修好了之后他家就是平地了, 你一点好处都没有
