请教一个翻译

请问这两个如何译成中文?
1. “rule by law”
2. “rule of law”

我个人的看法是1是"法治"，2是"法制"。但是又觉得差点意思。请问大家有何高见?

具体的英文上下文我回忆不起来了，是一个对比两种治国理念的一个讲课。一个是古罗马，说是"rule of law"，上下文大概是说法律最大。另一个讲君主制的体系，说是"rule by law"，上下文大概说这些国家虽然也有法律，但是君主用来统御民众的工具，君主最大。

版主贴的还是没太看懂。现在好像没有rule by law 这个概念，只有rule of law，也就是法治（社会）。
