I would not recommend family trust if the asset is not over $5m

孩子才5岁，不舍得，已经没有了爸爸，不想让孩子以后上不好的学校受穷被歧视，输在起点上

万一她有个意外什么的，孩子还有钱在不用怕

Totally understand! We are all mum and I know where your friend is from.

I would do pre-nuts + loan agreement if I were your friend. Pass on a very clear message to her potential partner that DO NOT TOUCH MY MONEY as it does not belong to him

it doesn't matter if she has the family trust before or after marriage, as long as she is the beneficia owner, the trust gets included in the asset pool.  

besides that, cost of managing the trust is from $3k a year, and the cost to establishing it is over $1k.  if she is doing it to protect those two houses bought by her parents, getting a legal loan agreement between her parents and her is more cost effective.  cost under $1k, and certified/witnessed by a proper lawyer.

One quick question

6.Keep assets held by you prior to the relationship in your sole name.  Avoid selling such assets and rolling them over into jointly owned property.

LZ's friend realestate is clearly held prior to the relationship, but the partner can still ask for it (if they get divorced one day). And that's why LZ and LZ's friend are still trying to find a way to avoid it
