看到工作版有人讨论notice period,该楼主说他的合同上是4周,他给了3周,公司不同意。

13.3 Job search entitlement

        Where an employer has given notice of termination to an employee,an employee must be allowed up to one day’s time off without loss of pay for the purpose of seeking other employment. The time off is to be taken at times that are convenient to the employee after consultation with the employer.

Clause 13.2 of that Award provides that the employee is required to provide the same period of notice of termination as is required by the employer under the National Employment Standards (NES).

The amount of notice of termination required to be given by the employee is based on the years of continuous service with the employer. This means the employee is required to give the following notice, based on years of continuous service with the employer:

    one week’s notice — less than one year’s continuous service
    two weeks notice — at least one year but less than 3 years continuous service
    three weeks notice — at least 3 years but less than 5 years continuous service
    four weeks notice — 5 years continuous service or more.


There is no additional one week’s notice if the employee is aged over 45 years.

人家如果说了是employment contract上签字了4周。这个4周没有比award/NES差,那么你跑不掉的。当然主要还是看你工作年份了。那个contract肯定也写了Notice period和工作年份有关的。一般实际就是和award/nes一样的。

要看你签的合同的。我在NSW工作时是2周,同样工作到VIC 就是4周。白纸黑字的合同,你赖不掉的。

This question as recently sent to WorkplaceInfo.

Q  Our employees are given a letter offer, on commencing employment, which states that one month’s notice is required to be given by the employee when terminating their employment.

One of our staff has given notice of resignation but she has only given us one week’s notice.

She claims this is all that’s required under the Fair Work Act 2009.

Our reading of the Act appears to be that the obligation of a minimum period of notice of termination applies only to the employer, not to the employee.

The employee is covered under the Clerks — Private Sector Award 2010.

What is the mandatory period of notice required to be given by the employee in this circumstance?

A  The statutory period of notice of termination provision in the Act only applies to the employer.

Award provides notice period

In this scenario, the period of notice required to be given by an employee to the employer is subject to the provisions under the Clerks — Private Sector Award 2010.

在澳洲,合同与法规有冲突的时候,哪个为准?

你这个例子就是合同比award/NES worse off的例子。如果没有worse off走的就是合同。

合同和法规冲突的时候,如果是employment 方面的。要看你的合同是否worse off。如果是,那么合同会被判定无效。走法规。

现在大部分的employment 合同都是直接copy award里的一些东西了,省的麻烦。。但是一个公司里面的人可能会被不同的award cover,比如电力公司的admin走的是clerk award,但是技术工作走的是ele award。不过其实关于notice的大部分都是相似。

I am looking for a new job now, I am an accountant. Could you please let me know how many week I need give to company by LAW?

合同规定员工提离职,要提前 4周;而公司辞退员工,按照3-5年的标准,是3周,不对等啊。

员工可以要求给3周吗?

Check if you have signed up a Collective Agreement with them. Personally, I believe there wont be a Collective Agreement because such a term could disadvantage an employee. The agreement will not be approved by FairWork.

If not you do not need to give them 6 weeks.

Generally, accountant is covered by Clerk Award. The notice period is the same as NES.

You only need to give them 2 weeks notice. (More than 1yrs - Less than 3 yrs)

同上,先确认下你有没有在enterprise agreement或是collective agreement上签字了。如果你签了,而且那个agreement被fairwork approve了,那你没有办法了。

但是fairwork一般不会approve这样一个让员工 disadvantage 的agreement的。

所以主要你要看看你是被哪个award覆盖。如果你和12楼一样是会计,那么你只要查NES就可以了。clerk award里面的notice period和nes是一样的。

这个合同应该是公司自己做的,实际上在这个关于notice period的方面是完全不合理的,只是很多人哪里知道,先签了再说呗。

最后你只要根据NES走,公司没脾气。(因为你的合同的condition比NES差)

实际就和楼主发的差不多。

只是如果你提前走的话,你们公司不管咋样,肯定会hold你的unpaid annual leave的,你要走法律手段要回来就要走一堆程序,很麻烦,而且时间较长,为了一点unpaid leave就不一定合算。一些公司利用这个心理来disadvantage员工。

I do not have collective agreement, I only have contract. I also feel it is not fair which I need give them 6 weeks notice and they only give me 4 weeks notice.

can I find legal document to support me? if yes, could you please give me a link?

可以,但是老板要同意。而且annual leave 一般来说也要给Notice,尤其像几周一样得。得看你的workplace policy
